In truth, that's an extraordinarily odd usage of the English language.  They actually operate PLC gear under a provision of Part 15 that basically exempts them from all other provisions of Part 15.  They only have to comply with conducted emission limits from the substation to the end user, and the current push for BPL basically throws that out the window too.  "We own the wires, that gives us the right to inundate you with RF."
