exactly my thoughts. if everyone rejected this mode on grounds that this 
is illegal, the author would be forced to either publish the specs, or to 
loose testing of his software by hams.

actually maybe this is the authors plot - let hams test the software for a 
while, and then sell it to some commercial customer (probably not 
military, but mine communications perhaps?)
